What the statute covers

Florida Statute 553.837 requires the builder to warrant covered construction defects in equipment, materials or workmanship that result in a material Florida Building Code violation. Its newly constructed home definition includes specified one- through four-unit dwellings that have not previously been occupied.

When the one-year period begins

Section 553.837 uses the earlier of original conveyance to the initial owner or initial occupancy. The required coverage continues during that year even if ownership changes. The coverage period is not a complete statement of every possible claim’s filing deadline.

Understand the exclusions

The statute excludes normal wear, normal settling within acceptable trade practices, specified purchaser-caused work or damage, and other listed events. Appliances or equipment covered by a manufacturer warranty fall outside the required warranty. A qualifying equal-or-greater express written warranty can supersede the statutory provisions.

Document and escalate carefully

Keep the contract, written warranties, closing and occupancy records, photographs and dated notices. Ask the builder to identify the process for reporting defects. Consult a qualified attorney about statutory notice requirements and deadlines rather than assuming a one-year warranty eliminates every other remedy.

Frequently Asked Questions

Is every cosmetic issue automatically covered?

No. Review the statutory coverage, exclusions and any broader written warranty.

Does resale restart the statutory year?

No. The required period starts with the earlier initial conveyance or initial occupancy.
